ABSENT: Trustees Basher and McGovern
The meeting began with the Pledge to the Flag.
REPORTS
Mayor Fixell announced that on October 4, 2007, Mayor Zegarelli, Mayor of Sleepy Hollow and he are sponsoring a global warming workshop for the Hudson River communities at the Tarrytown Senior Center at 7:30 p.m. Along with the Tarrytown Environmental Advisory Council, there will be a speaker from NASA as well as a general discussion of the topic to look at what local communities can do, have been doing and what can be done in the future. The public is invited as well as municipal officials from the area.
Trustee Butler reported on the following:
- The Planning Board approved the site plans for construction of new single-family homes at the intersection of Fairview and Altamont Avenue, 2 Emerald Woods and 6 Emerald Woods. They also approved site plans for a physical therapy office at 31 Main Street and 54 Main Street for a real estate office.
- The Planning Board is continuing site plan review for a new single-family home at 7 Emerald Woods.
- The Planning Board is continuing preliminary review of plans for a proposed subdivision at 116 Altamont Avenue.
- The Zoning Board of Appeals rendered an interpretation that a religious use is permitted in the R-60 zoning district.
Trustee Zollo read a letter written by 2nd Assistant Fire Chief, Michael Coffey, Jr. of the Tarrytown Fire Department addressed to the Mayor, Board of Trustees and the residents of Tarrytown. The topic is Fire Department Awards. “I am writing to inform you of some good news items that happened within our Fire Department. This past Saturday at the Westchester County Fire Prevention Convention Parade, Riverside Hose Company won two trophies; best pumper over 10 years old and 2nd best color guard. In addition, on Thursday September 13th, the following Fire Department members received the Westchester County Volunteer Firefighters Association “Firefighter of the Year” honorable mention certificates for their efforts in rescuing a young man from the
Hudson River who jumped off the Tappan Zee Bridge. Those members were Bill Logan, Sr., Frank Morabito, Kelly Murphy, Charles Boyce, Gene Gasparri, Patrick Derivan, Michael Coffey, Jr., Bill Logan, Jr., and John Kelly.”
Trustee Zollo congratulated all of those members and Riverside Hose Company.
ANNOUNCEMENT OF A PUBLIC HEARING TO BE HELD ON OCTOBER 1, 2007 REGARDING AN AMENDMENT TO THE VILLAGE ZONING CODE WITH RESPECT TO FLOOR AREA RATIOS (F.A.R.).
ANNOUNCEMENT OF A PUBLIC HEARING TO BE HELD ON OCTOBER 1, 2007 REGARDING PROPOSED AMENDMENT TO THE VILLAGE ZONING CODE WITH RESPECT TO IMPERVIOUS SURFACE COVERAGE.
OPPORTUNITY FOR THE PUBLIC TO ADDRESS THE BOARD: SPEAKERS HAVE 5 MINUTES BEFORE YIELDING TO THE NEXT PERSON: THEN 3 MINUTES FOR ADDITONAL COMMENTS
Dina Jolly, Tarrytown resident, requested the Village Board to facilitate a change in the Board of Directors meetings of the Library from where it is being held now to the main reading room and make them open to the public. At the present time, the meetings are being held upstairs in a very small conference room. Ms. Jolly feels that the public has been excluded and kept uninformed where there has been virtually no communication at all. One of her concerns is inefficient parking for the number of programs being held at the Library. Mayor Fixell stated that they are currently working with the library on providing parking for the staff at the McKeel Avenue parking lot. Trustee McGee stated as a liaison to the library, she will be attending the Library’s Board of Director’s meeting
this Thursday and will call ahead of time to suggest the meeting be moved to a larger area.
Jonathan Gleit, Tarrytown resident, thanked the Board for their governmental service. He stated the following:
- Due to the poor quality of the audio and video of the meetings lately, he has not been able to follow the Village business. He hopes with the new Village Hall, better accommodations will be made for improved audio and video and perhaps live web casting of the meetings could be feasible.
- He likes the new website; however, he would like to suggest that the Planning Board agenda be posted on the website in a timely manner prior to the meetings. He further suggests that when an application is submitted to the Planning Board and the Architectural Review Board that all the plans should also be submitted on CD so that it could be included as part of the agenda as a link on the website to actually see the plans.
- He inquired about utilizing canoes and kayaks on the Tarrytown Lakes. Trustee Hoyt stated that we are currently working on a proposal to present to the Board where we can open the Tarrytown Lakes to utilize canoes, paddle boats and/or kayaks.
- He questioned what ultimately will happen with the two unfilled sidewalks between the Tarrytown Lakes parking lot and the road. Mayor Fixell stated that we will plant grass on the small one. The larger one was designed and planned as a sidewalk with slanted edges so that buses can turn around.
- There has been a national and state wide suggestion to revise Building Codes in order to heighten environmental aspects of the codes. For example, greater insulation, green roofs, green codes, to make buildings more efficient. There are a number of benefits globally and nationally, and locally.
CONSIDERATION OF AN INTER-MUNICIPAL AGREEMENT (IMA) BETWEEN THE VILLAGE AND WESTCHESTER COUNTY REGARDING THE COUNTY’S PARTICIPATION IN AND FUNDING OF THE SCENIC HUDSON RIVERWALK PARK.
The Board of Trustees tabled this resolution to the next regular board meeting. The County has not provided the IMA.
AWARD OF THE ELECTRICAL CONTRACT FOR MODIFICATIONS TO SHAFT 10 PUMPING STATION.
Trustee Hoyt moved, seconded by Trustee Zollo, and unanimously carried that the following be approved: Approved: 5-0
BE IT RESOLVED that the Board of Trustees of the Village of Tarrytown hereby awards the electrical contract for the Modifications to Shaft 10 Pumping Station to D. Owens Electric, Inc., 15 Mark Lane, Hopewell Junction, New York for the low bid of $13,950, as recommended by our water consultants, Professional Consulting, LLC and our Village Engineer, Michael McGarvey. The bid results are as follows:

RESOLUTION – FIRE DEPARTMENT PERSONNEL CHANGES
Trustee McGee moved, seconded by Trustee Zollo, and unanimously carried that the following be approved: Approved: 5-0
BE IT RESOLVED that the Board of Trustees of the Village of Tarrytown approves the following Fire Department personnel changes recommended at the August 21, 2007 Board of Fire Wardens meeting: New Membership: Stephen C. Giampiccolo was approved to Active membership in Hope Hose Company and Dmitriy Danilov was approved to Out-of-Town Active membership in Hope Hose Company.
RESOLUTION REGARDING THE CONSTRUCTION OF SCENIC HUDSON RIVERWALK PARK AND THE BOARD OF TRUSTEES’ DESIGNATION OF ITSELF AS LEAD AGENCY FOR REVIEW OF THE ENVIRONMENTAL ASSESSMENT FORM (EAF) AND THE ENSUING SEQR PROCESS
Trustee Zollo moved, seconded by Trustee Butler, and unanimously carried that the following be approved: Approved: 5-0
BE IT RESOLVED that the Board of Trustees of the Village of Tarrytown hereby declares its intent to be lead agency with respect to the State Environmental Quality Review Act (SEQRA) review of the plans for the construction of Scenic Hudson Riverwalk Park.
TAX CERTIORARI – TARRYTOWN HALL CARE CENTER
Trustee Zollo moved, seconded by Trustee Hoyt, and unanimously carried that the following be approved: Approved: 5-0
BE IT RESOLVED that the Board of Trustees of the Village of Tarrytown hereby
Authorizes the settlement of the Tarrytown Hall Care Center tax certiorari case as recommended by the Village Attorney in his memorandum dated September 11, 2007.
APPROVAL OF STIPULATION OF AGREEMENT BETWEEN C.S.E.A. AND VILLAGE
Trustee Hoyt moved, seconded by Trustee McGee, and unanimously carried that the following be approved: Approved: 5-0
WHEREAS, the negotiating committees for the Village and the CSEA, Local 1000, AFSCME, AFL-CIO, Westchester County, Village of Tarrytown Unit (“CSEA”) entered into a Stipulation of Agreement dated June 6, 2007 for a successor contract to the collective bargaining agreement that expired May 31, 2006; and
WHEREAS, the Village has been notified in writing that the membership of the CSEA voted to ratify the Stipulation of Agreement dated June 6, 2007; and
NOW, THEREFORE, the Board of Trustees of the Village of Tarrytown hereby approves the terms of the Stipulation of Agreement dated June 6, 2007 for a successor contract to the collective bargaining agreement that expired May 31, 2006.
APPROVAL OF THE MINUTES OF THE REGULAR MEETING OF THE BOARD OF TRUSTEES HELD ON SEPTEMBER 4, 2007
Trustee Butler moved, seconded by Trustee Zollo, and unanimously carried that the following resolution be approved: Approved: 5-0
BE IT RESOLVED that the Board of Trustees of the Village of Tarrytown hereby approves the minutes of the regular meeting of the Board of Trustees held on September 4, 2007 as submitted by the Village Clerk.
APPROVAL OF AUDITED VOUCHERS #5
Trustee Hoyt moved, seconded by Trustee Zollo, and unanimously carried that the following resolution be approved:

The Board was polled all voting “aye” with the exception of Trustee McGee who abstained from Voucher Numbers 001243 and 001290 and Trustee Hoyt who abstained from Voucher Number 001166, 001260, 001269, 001281, 001296, and 001206. Motion carried 5-0.
WASHINGTON ENGINE FIRE COMPANY, CONSOLIDATED ENGINE FIRE COMPANY, AND VILLAGE HALL CONSTRUCTION UPDATE
Michael J. McGarvey, Village Engineer, reported on the construction update for the following projects:
WASHINGTON ENGINE FIREHOUSE – RTE. 119
The interior framing has just been finished. The masonry is under construction. The veneer stone on the bottom has been finished and they have started on the brick work.
The mechanical, electrical and plumbing rough-ins has been complete. The structural steel for the elevator will begin this week. The completion date is on schedule for late November, 2007.
CONSOLIDATED ENGINE – MEADOW AND SHELDON AVENUES
The interior and exterior framing is complete for the 1st and 2nd floors. The roof sheathing will begin later this week. The roof bracing is complete. The sewer was connected this week. The sewer drains are in. The structural steel for the elevator will begin next week. The completion date is on schedule for December, 2007.
NEW VILLAGE HALL/POLICE DEPT. /COURT
Currently completing the welding of all the moment connections. Ready to pour the 2nd floor next week. Roof framing has not been done yet because they want to pour the 2nd floor through the outside first. After that the roof metal framing will go up. Then the block work will get done. The completion date is a little ahead of schedule for the summer of 2008.
